My van was parked two doors down from a Formosa work site, when a Formosa truck smashed into it. The van was parked on the side of the road. Charles Formosa just continued driving down the street, backed into his job site, the truck was full of stones, he emptied his truck, he just got on with his life like nothing happened, it wasn't until I walked down the street to him and asked him if he'd hit my van, did he actually communicate about it. And would you believe it, he blames me. He gives me a hard time. Then he has his lawyer call me, trying to have me pay for Formosa's damages, I could have been singing praises about professional conduct, but I haven't seen or even heard of any yet. I was gob smacked when the lawyer informed me, that where Charles lives, in a suburb called machans beach, his lawyer actually told me over the phone that the people of Cairns are dangerous but Machans beach people are the worst, the lawyer gives a few examples, one of them being that all the people in machans beach hate a particular family, so much so that they poured petrol over a seven year old child and set him alight. Guess where Charles Formosa address on his licence is. I don't know why anyone would ever do that let alone talk it up, I could only imagine it was in context to scare me. Formosa construction hasn't offered a apology, hasn't given me their insurance details, the lawyer at first says there's $2000 damage then says $3000 damage to the Formosa contruction truck but they are happy to pay for their damage if I don't pursue them. In the photos of his damage, there looks to be damage repairable by bending a piece of metal and replacing a nut and bolt.
Would you want this level of maturity operating dangerous machinery? Would this kind of indecent responsibility be something you want to face on a expense such as construction if something was damaged? How would you feel having to live with difficulties like this because Formosa had clearly in my experience has every chance to own his actions, but prefer to damage my van, my life, and tell me it's my fault. Legally speaking, property, that's parked, you can hate it, you can report it, but can't damage it, that's against the law. Who in there worst behaviour would blame someone else for driving into them? My vehicle is registered in Victoria, I didn't buy insurance. I have never in 24 years of driving cars vans trucks, had any accident. I'm a excellent, reliable, patient responsible driver who has parked on the Esplanade in Cairns and had the misfortune as being parked in Charles Formosa path. Now I have damages I can't get fixed, thanks to covid, a lawyer threatening on behalf of the man who drove into my van and at this point in time I can't recommend more that Formosa take their community responsibilities into training. Possibly get eye tests, drug tests and driving tests. Why would anyone drive so close to a vehicle that they hit it. Why would anyone blame the parked vehicle for being there, something's wrong. Really wrong. If you've had difficulty please leave a report about it.
I'm very forgiving person, but I've been through it about this for a long time now, at this stage, with even professional advice, I realise now, this is a after the event willful damage.
